BC CANCER FOUNDATION - Volunteer Agreement

Overview

This Volunteer Agreement (the “Agreement”) defines the relationship between the BC Cancer Foundation, including its directors, officers, employees, representatives and agents, and the “Volunteer” named in the Better Impact on-line application.
The Volunteer agrees as a precondition to their volunteering for BC Cancer Foundation and in consideration of the BC Cancer Foundation allowing the Volunteer to do so, that the Volunteer will strictly be bound by the terms of this Agreement.
The Volunteer is not an employee or contractor of the BC Cancer Foundation and is not compensated for their time while volunteering for the BC Cancer Foundation.
Volunteers should contact communityevents@bccancer.bc.ca if they have any questions or concerns about this Agreement or while volunteering for the BC Cancer Foundation.


Code of Conduct – Volunteers agree that they will:

Perform volunteer duties to the best of your abilities.
Treat BC Cancer Foundation volunteers, employees and members of the public fairly, and fostering an environment free of bullying, harassment, and/or discrimination.
BCCF considers Discrimination and Harassment a serious offence and will not tolerate harassing behaviour which may undermine the respect, dignity, self-esteem or productivity of any person.
Respect the property of the BC Cancer Foundation and of the venues and/or properties in which volunteer activities occur
Be courteous, friendly, patient, flexible, enthusiastic and cooperative.
Honour volunteer, staff and donor confidentiality.
Offer constructive feedback about our organization in an appropriate and timely manner.
Follow through on commitments and advise their supervisor or volunteer coordinator in a timely manner if unable to perform work as scheduled.


Confidentiality

I acknowledge that during my time within the business offices of BC Cancer Foundation, or through remote access while working with BC Cancer Foundation staff, Confidential Information (as defined hereafter) of BC Cancer Foundation may be disclosed and that any unauthorized disclosure of such information to third parties or use other than for BC Cancer Foundation’s purposes could cause extensive harm to BC Cancer Foundation.



“Confidential Information” of BC Cancer Foundation includes any and all trade secrets, confidential, private or secret information of BC Cancer Foundation not generally known to the public including, without limitation, any and all inventions, discoveries, concepts, technology, technical knowledge, know-how, trade secrets, schematics, drawings, technical and functional specifications, systems, procedures, programs, computer software, source code, client data base, products, equipment, material, research data, developments, improvements, mechanisms, composition of matter, design methods, formulae, plans, skills, services, methods of doing business, business and marketing plans, financial, legal, corporate, customer, supplier, personnel, research, commercial or technical information, and/or other non-public information in whatever form or media as BC Cancer Foundation may from time to time designate as being confidential to BC Cancer Foundation.



Confidential Information will not include information that is in the public domain, or information that falls into the public domain, unless such information falls into the public domain by disclosure or other acts by me, or through my fault.



I undertake with BC Cancer Foundation that I will not during my time within the BC Cancer Foundation Offices or remotely or at any time thereafter, unless prior written consent is given by BC Cancer Foundation, either directly or indirectly, utilize on my own behalf or on behalf of any other person, firm or company (a “person”) or disclose to any other person any Confidential Information of BC Cancer Foundation, and I shall use my best efforts to prevent the unauthorized disclosure or publication of such information.



In addition, I agree that I will not reproduce, copy, duplicate, manufacture, or sell any Confidential Information of BC Cancer Foundation including any materials belonging to BC Cancer Foundation nor remove same from BC Cancer Foundation’s premises or systems without the express written permission of BC Cancer Foundation. I recognize and acknowledge that a breach of this provision may result in the institution of legal proceedings against me.



Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity

The Volunteer acknowledges that accidents can occur with or without any fault on the part of the Volunteer or the BC Cancer Foundation, and that volunteer at the BC Cancer Foundation is at the Volunteer’s own risk.
The Volunteer hereby waives any and all claims, which they may have against the BC Cancer Foundation and release the BC Cancer Foundation from any and all liability for injury, death, property damage or any other losses sustained by the volunteer or the volunteer’s next of kin as a result of volunteering for the BC Cancer Foundation, due to any cause whatsoever, including without limitation, negligence, breach of contract, or breach of any statutory or other duty of care by the BC Cancer Foundation.
The volunteer further agrees to indemnify the BC Cancer Foundation for any claims, demands, obligations and causes of action arising for any costs, expenses and compensation of any kind whatsoever, including but not limited to legal and other professional fees, made by any person or entity arising in relation to their volunteering for the BC Cancer Foundation.
In the event of any accident or illness affecting the Volunteer, the Volunteer authorizes BC Cancer Foundation to authorize, on their behalf, all procedures, including admission to hospital and any necessary treatment therein deemed essential for the care and well-being of the Volunteer. Such action is only to be taken when immediate authorization from the Volunteer cannot be obtained. It is understood that the BC Cancer Foundation is not responsible for any medical care costs.


Termination

This Agreement will continue indefinitely until terminated by either the BC Cancer Foundation or the Volunteer.
The Volunteer understands and fully accepts that the BC Cancer Foundation reserves the right, at any time, to refuse, without penalty or compensation, their continued volunteering for the BC Cancer Foundation, as determined at the sole discretion of the BC Cancer Foundation or its Agents that the Volunteer is a hazard to themselves, or other volunteers, or BC Cancer Foundation staff or the public. BC Cancer Foundation is not required to disclose the reasons for termination.
